Biden’s Border Theater

Joe Biden is issuing a sprawling executive order that will significantly reduce the number of asylum claims at the southern border.

Details: The order would give border agents the authority to turn back migrants before they can seek asylum status once daily illegal crossings surpass 2,500. The current daily crossing average for the past three weeks is over 3,700.

Problem: According to The Wall Street Journal, Biden is pressing forward “despite advice from legal and operational advisers that such an order would likely be struck down in court—and, even if it survived legal scrutiny, would prove tough to fully implement.” The order would require significant funding from the Republican-controlled Congress only five months ahead of election day.

New: Swing state Democrats who face tough re-election prospects are sidestepping the President’s executive order as a growing number of Americans are dissatisfied with Biden’s border management. Senators Jon Tester (D-Mont.), Tammy Baldwin (D-Wisc.), Jacky Rosen (D-Nevada), and Bob Casey (D-Penn.) have all refused White House invitations to participate in the action’s announcement.

Related: An illegal immigrant from Venezuela shot two police officers in New York City early Monday morning when police attempted to stop his moped. The migrant was apprehended at the border last year but had his immigration case dropped allowing him to remain in the country indefinitely. The news comes as 350,000 asylum seekers have had their cases against them closed by the federal government since 2022.
