BREAKING: SCOTUS EPA Ruling - Major Questions Doctrine

The Supreme Court dealt a blow to the Biden administration by ruling the EPA does not have authority to set sweeping regulations without congressional approval. The implications of this case ostensibly limit the authority of other government agencies to address significant policy questions without a vote from congress. What does this mean? Unelected agency heads can no longer set standards that upend entire industries.

You’re going to hear a lot about the “major questions doctrine.” Here’s an explainer from CNBC:

Chief Justice John Roberts wrote the majority opinion, in the case, known as West Virginia v. the Environmental Protection Agency, which was joined by the Supreme Court’s other five conservative members.

The decision is the first time a majority opinion explicitly cited the so-called major questions doctrine to justify a ruling. That controversial doctrine holds that with issues of major national significance, a regulatory agency must have clear statutory authorization from Congress to take certain actions, and not rely on its general agency authority.

Yesterday, she clarified the statement by telling a Los Angeles Times reporter “the president intends to run and if he does, I will be his ticket mate. We will run together.” Here’s more from National Review.

Biden Says He Supports Exception to Filibuster to Codify Roe v. Wade Into Law

This is from The Wall Street Journal with emphasis added.

President Biden said on Thursday that he supports temporarily suspending the filibuster, if necessary, to pass legislation codifying Roe v. Wade into law.

“The most important thing to be clear about is we have to codify Roe v. Wade into law and the way to do that is to make sure Congress votes to do that,” Mr. Biden told reporters during a press conference in Spain. “And if the filibuster gets in the way, it’s like voting rights, it should be provided an exception for this…to the filibuster.”

Changing the filibuster rules of the Senate would allow legislation protecting abortion access to pass the chamber with 51 votes rather than the 60 votes usually required for bills to advance. Mr. Biden had previously backed an exception to filibuster rules to pass long-stalled election bills.

The filibuster could be changed with a simple majority vote, but not all Democrats in the 50-50 Senate are on board with such a move, saying it would fundamentally change the nature of the Senate and could backfire if the GOP takes control of the chamber.

'Certainly possible': Illinois governor says Biden could face primary challenge

Democratic Gov. J.B. Pritzker told NBC News on Wednesday “it’s certainly possible” that President Joe Biden could face a primary challenge should he run for re-election in 2024.

Pritzker, who fueled speculation about White House ambitions this month with a speech in the first presidential primary state, New Hampshire, and has raised eyebrows with generous donations to battleground state governors, added that he’s not pushing for a challenger to step forward.
