Congressman Matt Gaetz of Florida is a brilliant pick for Attorney General. Overnight, he resigned his House seat after just getting re-elected. While some think Florida should, logistically, be able to call and hold a special election for Gaetz’s seat prior to January 3, 2025, given Gaetz’s resignation last night as confirmed by Speaker Mike Johnson, most elections lawyers I have spoken to think that might not be possible.
It should be noted that Speaker Johnson is the happiest man on earth today. Gaetz allegedly had been plotting behind the scenes to find someone to challenge Johnson, but that ended last night.
Gaetz has burned every possible bridge in the House of Representatives, and his colleagues want him gone. The House Ethics Committee intended to vote in two days to release its investigation into Gaetz and human trafficking. Only one Republican on the Ethics Committee needed to vote yes, and that would happen. If the Senate holds hearings, that will still come up. Gaetz’s departure last night killed the investigation. That suggests that this nomination is to provide pre-text for Gaetz’s resignation, and the subtext is a congressional finding that Gaetz possibly engaged in sex trafficking of young women.
Senate Republicans have no desire to confirm him. Some of those Senators just got elected to six-year terms and will outlast Donald Trump. Others do not care because they either have four years or are retiring. Gaetz can only lose four.
Susan Collins is a no. I suspect Mitch McConnell is a no. Lisa Murkowski? I doubt she’d support him. Tom Tillis? Really? Bill Cassidy?
How about this Trump whisperer from Oklahoma?
Late last night, Senator Mullin suggested he would be a no vote.
Both of Donald Trump’s prior Attorneys General started as MAGA heroes and ended as MAGA villains. Jeff Sessions was ridiculed and laughed out of office after being celebrated as a brilliant pick. Bill Barr was branded a traitor.
Either Matt Gaetz is not confirmed and goes through a Cersei Lannister shaming that destroys his gubernatorial bid in 2026, or he gets a recess appointment into the office where he becomes the fall guy for Trump.
So Gaetz will either have to be highly successful in his position, or he will, like Icarus, crash after getting too close to the sun.
In the meantime, Donald Trump must show the American public that he is competent. Suppose Gaetz, Noem, Tulsi Gabbard, etc. prove inept. In that case, the GOP will be destroyed in 2026, and MAGA will have to rethink itself with Vance in 2028 to survive the wrath of voters willing to throw out parties in Washington that fail to deliver continually.
Donald Trump must get three things right — the border, crime, and the economy.
On the border, he has pleased no one, including his MAGA base, with Kristi Noem, whose incompetent leadership in South Dakota saw her fight for closures during COVID and fight for trans-rights due to her donors until Republicans overwhelmingly opposed both, and she pivoted to take credit for the GOP’s positions. Noem caved to the NCAA on trans issues.
On crime, Gaetz can perhaps purge the bureaucracy of those opposed to Trump, but he practiced law for 25 months before taking his seat in Congress. Ever since, he has been mired in scandal. But his pick has, overnight, improved the morale of the House GOP with his departure.
Let Donald Trump have his cabinet. In two years, let the voters judge the GOP and Trump on his picks.
Either we will have results or a body count as Trump runs over and destroys people like Gaetz.
But the reality is, I suspect, that Trump is rewarding Gaetz for his loyalty while knowing the Senate will never confirm him. That makes Gaetz a brilliant pick. Trump gets to reward his friend while feeding Gaetz to the lions. Good riddance.
Gaetz’s pick not only spares the House Republicans his presence but probably saves the Florida GOP a messy primary for Governor in 2026 because Gaetz will either be in DC or in tatters.
Don’t be surprised if Gaetz’s nomination never actually advances. His resignation ended the congressional investigation into allegations he participated in sex trafficking. Don’t be surprised if that report leaks. But he can say he left to be AG, even if he never gets there. He’ll blame the RINOs and get a TV contract. He gets an exit to escape the investigation and never gets to the Department of Justice.
With that, Trump improved the House GOP conference and helped Byron Donalds’ Florida gubernatorial bid in 2026.

I was very surprised to see the 'headline' for this post as I really think Gaetz is a moonbat (& like MTG, needs to go away). If this really is the true 'chess move' you've outlined, I'm actually quite impressed with the orange one. Regardless, happy to see him leaving Congress for sure & hoping the Senate does their job, denying him this position!
Never thought I’d be happy for Lisa Murkowski’s and Susan Collins’s non-party line votes, but I am on the potential Gaetz confirmation vote! Hoping he is not confirmed with a recess appointment.
