I feel sorry for the TV networks. Outside of Fox, the prevailing legal talking heads are almost all uniformly both of the left and of La Resistance — long committed that Donald Trump should be in prison. It’s one reason CNN was smart to part ways with Jeffrey Toobin. The man has a long record of leftwing partisan hackery and could not be fairminded in his analysis.
It’s tough to find a lawyer with a bit of humility to assess the situation in Florida with Judge Cannon. To hear Resistance Legal Twitter, reflected in much of the press, there was no way Judge Cannon would or should order a special master review of Donald Trump’s documents.
That’s precisely what she did yesterday.
The anti-Trump contingent of supposed legal experts insisted it had to be because Judge Cannon is a partisan appointed by Donald Trump.
It could also be that this is a novel situation unprecedented in the republic’s history whereby a former President both took en masse classified documents to his post-presidential home, and the federal government raided1 his home to retrieve those documents as it potentially builds a legal case against him.
The Supreme Court has previously said a former president may have the ability to exert executive privilege even against a current presidential administration. The Court never sorted out where the lines were for such an assertion.
So this is a very novel situation, the hubristic bluster of progressive legal eagles notwithstanding.
Judge Cannon should not have dragged her feet on the order. Donald Trump's team should not have dragged their feet in asking for the special master. The DOJ should not have kept plowing through the documents knowing the judge seemed most likely to order a special master.
Again, though, the whole situation is unique in American jurisprudence. Rarely would any of us encounter anything like this.
That should have forced every commentator to exercise some humility and discernment. Instead, the loudest voices online and on television are insistent the judge issued a partisan decision designed to help Donald Trump that will most assuredly be reversed by an appellate court, the majority of whom are also Trump appointees.
Maybe, just maybe, people need to stop being so sure of both unknown outcomes and the explanations for the outcomes when they turn out differently.
